These Terms of Service (“Terms”) govern your use of Bitcoin Gem Miner and its related websites and services (together, the “Services”), which are published and operated by HTSW Wear.
1. Acceptance of These Terms
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. If you use the Services on behalf of another person or organization, you represent that you are authorized to accept these Terms for them.
2. Nature of the Game
Bitcoin Gem Miner is an entertainment and simulation game. Virtual miners, simulated mining power, balances, progress, and rewards are game features. The Services do not use your device to conduct real cryptocurrency mining and are not an investment, banking, brokerage, or guaranteed-income service. No game statement should be understood as a promise of profit, investment return, or guaranteed payment.
3. Eligibility and Accounts
You must meet the minimum age and other eligibility requirements that apply in your location and on the platform where you obtained the game. You are responsible for activity associated with your account and for keeping your device and access credentials secure. Information you provide must be accurate and must not impersonate another person.
4. Limited License
Subject to these Terms, HTSW Wear grants you a personal, limited, revocable, non-exclusive, non-transferable license to use the Services for private, non-commercial entertainment. You may not copy, sell, sublicense, reverse engineer, modify, distribute, or commercially exploit the Services except where applicable law expressly permits it.
5. Virtual Items and Game Progress
Virtual items, currencies, balances, miners, mining power, and progress are licensed game content and do not give you ownership of intellectual property or real mining hardware. Their availability, limits, and operation are determined by current game rules and applicable platform requirements. We may correct errors, duplicate grants, or unauthorized activity where reasonably necessary to preserve the integrity of the Services.
6. Purchases
If paid content is offered, purchases are processed by the applicable app store and are subject to its terms, pricing, regional availability, and refund rules. The store’s confirmation controls the amount charged. Do not make a purchase unless you understand the displayed product and price. A purchase does not guarantee financial returns or a particular game outcome.
7. Acceptable Use
You must not cheat, automate unauthorized actions, exploit errors, interfere with security, attempt to access another player’s account, submit malicious content, harass others, manipulate transactions, or use the Services for unlawful activity. You must not present game content as proof of real mining activity or a guaranteed financial opportunity.
8. Third-Party Services
The Services may interact with app stores, advertising providers, analytics providers, customer-support tools, or other third-party services. Those services may have their own terms and privacy practices. HTSW Wear is not responsible for third-party services outside our control.
9. Ownership
The Services, including software, artwork, characters, text, design, audio, trademarks, and other content, are owned by or licensed to HTSW Wear and are protected by applicable intellectual-property laws. These Terms do not transfer any ownership rights to you.
10. Availability and Changes
We may update, suspend, limit, or discontinue features when reasonably necessary for operation, safety, legal compliance, platform requirements, or product development. We do not guarantee that every feature will be available at all times, on every device, or in every region.
11. Disclaimers
To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes rights that cannot lawfully be excluded.
12. Limitation of Liability
To the maximum extent permitted by applicable law, HTSW Wear and its affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the Services. Where liability cannot be excluded, it will be limited only to the extent permitted by law. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13. Suspension and Termination
You may stop using the Services at any time. We may restrict or terminate access when you materially breach these Terms, create security or legal risk, or misuse the Services. Provisions that by their nature should survive termination—including ownership, disclaimers, limitations, and dispute-related provisions—will survive.
14. Changes to These Terms
We may update these Terms to reflect changes to the Services, law, or our practices. We will update the revision date and provide any additional notice required by applicable law. Continued use after an update takes effect constitutes acceptance where permitted by law.
